COPYRIGHT NOTICE
All intellectual property rights whatsoever, wheresoever and whensoever subsisting in information or any services, goods or works (including, without limitation, drawings, sketches, artwork, typography and photography) invented, devised, made, created, acquired or written by or for Moto Trader (whether or not in connection with any contract with advertiser) shall be and remain Moto Trader’s absolute property.

Neither the advertiser nor any other person shall, have any license or other rights whatsoever under or in respect of the said intellectual property rights. The advertiser undertakes that it will not reproduce or authorize or procure any other person to reproduce any of the said artwork, typography, photography or other works without the written agreement of Moto Trader. The advertiser hereby assigns all its rights (if any) in and to the said intellectual property rights to Moto Trader.

The advertiser must ensure that he/she has obtained the appropriate permission to reproduce any artwork, logos, designs, trade names and trade services marks which he has supplied to or asked the company to incorporate in any advertisement to be published in the company’s publications. 

ADVERTISING CONDITIONS OF ACCEPTANCE
It is a condition of acceptance of advertising orders that MOTO TRADER does not guarantee the insertion of any particular advertisement on a specific date or at all. Although every effort will be made to meet the wishes of the advertiser. Further, MOTO TRADER does not accept liability for any loss or damage caused by an error in accuracy in the printing of any advertisement. MOTO TRADER also reserves the right to correctly classify, edit or delete any wrong wording or reject any advertisement.

STANDARD TERMS & CONDITIONS 

• All advertisements must be pre-paid.
• The advertisement copy provided by the Customer must be legal, decent, honest and truthful.
• Moto Trader is not able to verify the truthfulness of any statements made by a Customer in the advertisement copy. Accordingly, the customer will be responsible for any losses, expenses or other costs incurred by Moto Trader which are caused by an untrue statement made deliberately by the customer.
• Moto Trader will take a photograph of the vehicle free of charge for the purpose of the advertisement, Moto Trader reserves the right not to include a photograph if the quality is not of a sufficient standard. The copyright of all photographs taken by Moto Trader or its agents will be owned by Moto Trader and the customer hereby assigns all such copyright to Moto Trader.
• In order to meet its production and other editorial requirements, Moto Trader reserves the right to re-classify, edit the copy or alter the size or colouring of any advertisement.
• Where Moto Trader makes changes to a Customer’s advertisement, every effort to contact the customer to explain the reasons for those changes (provided this is practicable within the production timetable) will be made. Where Moto Trader prints a changed advertisement of a lesser value, the Customer will be entitled to a refund of the difference in price between the type of advertisement purchased by the customer and the advertisement printed by Moto Trader.
• In the event of the complete omission, cancellation or mismatch of an advertisement by Moto Trader, the Customer will be entitled to re-run of the correct version of the advertisement, or a refund of the advertisement price unless the omission, cancellation or mismatch by Moto Trader is caused by unforeseen circumstances beyond the reasonable control of Moto Trader, or breach of contract by the customer has given special instructions about blanking out the registration number of the vehicle, increasing the probability of a mis-match.
• Alterations to advertisement may be made prior to copy deadline.
• Moto Trader’s liability for breach of contract or negligence will not exceed an amount equal to the price of the advertisement or series of advertisements involved, provided that nothing in this cause will limit Moto Trader’s liability for death or personal injury caused by its negligence or that of its servants of agents.
• Once an advert has been placed and the deadline has passed no refund will be given.
• Special offer package deals are non refundable after the first advert has appeared.
